Privacy Notice for people interested in our properties for sale
We are providing you with this information to comply with data protection laws and to ensure that you are fully informed and we are transparent in how we collect and use your personal data.
Who is collecting the information?
The Church of Scotland is the Data Controller. The Church of Scotland has an appointed Data Protection Officer (DPO), Alice O'Sullivan, who can be contacted by emailing: Privacy@churchofscotland.org.uk
Why are we collecting it and what are we doing with it (Purpose)?
We collect information from you whenever you engage with us in order to note your interest in a property and to arrange a viewing. We will log the details in our system for the purpose of keeping you up to date on the property e.g. if the price changes or it goes to a closing date.
What personal data do we collect?
We will collect your full name and contact details (such as phone number, email address and postal address) from you whenever you engage with us.
If you instruct a solicitor to act on your behalf to note interest in a property for you, we will collect only your name. If you gave any information as to accessibility or other needs for the purpose of viewing a property, then we will hold that information too.
How are we collecting this information? What is the source?
We collect your personal information directly from you when you contact us by telephone or email, via our website or via third party websites on which we advertise our properties e.g. Zoopla, Rightmove Commercial or a Solicitors Property Centre. The third party websites will, if you use the function to note your interest, pass your query on to us regarding the property you are interested in.
The lawful basis for the processing
The lawful basis for the marketing and sales of properties is UK GDPR Article 6(1)(b) "processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract"
Who we share the information with
We will pass your contact details on to sellers and viewing agents in relation to any interest or viewings you confirm. If you are purchasing a property where we are acting as agents for the seller we will share your personal information with your appointed solicitors, the seller and the solicitors acting for the seller.
We use Microsoft and NetDocuments to store your personal data. They are acting as processors and act on our instructions only with an appropriate contract in place.
How long do we hold the personal data?
For property sales, we securely delete the contact information on final completion of the sale of the property following Church procedures.
Individuals' rights in relation to this processing
Under data protection laws individuals have a number of rights, these are detailed here.
For the purposes of processing for employment purposes, all the rights apply except for the Right to Object. If you wish to exercise any of your rights, please contact the Data Protection Officer (DPO) at Privacy@churchofscotland.org.uk who will process your request accordingly and without undue delay, within the one month deadline.
